From Mother Title to your Title: A 7-Step Guide

 

A purchased portion of land that is still covered by a "Mother Title" cannot be immediately transferred into the buyer's name. The property must first be subdivided so a separate title can be issued.

The 7-Step Process

  1. Secure a Notarized Deed of Absolute Sale (DOAS): This document serves as the primary proof that you are the legitimate buyer of that specific portion of land.
  2. Conduct a Land Survey: Hire a licensed geodetic engineer to survey the property and create a formal Subdivision Plan.
  3. Approve the Subdivision Plan: Submit the subdivision plan for approval to the appropriate government agencies, such as the Department of Environment and Natural Resources (DENR) or the Land Registration Authority (LRA).
  4. Settle Taxes with the Bureau of Internal Revenue (BIR):
    • Pay the Capital Gains Tax (CGT), which is 6% of the tax base (whichever is higher between the selling price or the zonal value).
    • Pay the Documentary Stamp Tax (DST), which is 1.5% of the tax base.
    • Once paid, secure your Certificate Authorizing Registration (CAR/eCAR).
  5. Pay the Transfer Tax: Settle this at the Local Treasurer's Office of the city or municipality where the property is located. Rates typically range from 0.50% to 0.75% depending on the Local Government Unit (LGU). This must be completed before registering the transfer.
  6. Register at the Registry of Deeds: Submit all necessary documents to the Registry of Deeds. This step formally cancels the old Mother Title and issues a new, separate Transfer Certificate of Title (TCT) for your subdivided lot.
  7. Update the Tax Declaration: Finally, visit the Assessor's Office to transfer and update the Tax Declaration into the new owner's name.

Important Reminders Before Buying

  • ⚠️ Cooperation is Mandatory: If the original owner of the Mother Title refuses to cooperate with the subdivision and transfer process, you cannot immediately get a title for the portion you purchased.
  • ⚠️ Establish Clear Agreements: To avoid major problems down the line, make sure you have a clear agreement with the seller regarding the subdivision process and the issuance of a separate title before you buy a portion of their land.
